DS-864E: Public Comment Requested on an Affidavit of Support Exemption Form
What this notice means: This is a request for public comment on a proposed information collection. It is not a final rule changing visa eligibility.
What Is the Proposed Change?
The U.S. Department of State is proposing a new form, DS-864E, to replace the previously used Form I-864W, which was discontinued on October 17, 2024. This new form is intended to help determine whether an immigrant visa applicant qualifies for an exemption from submitting the Affidavit of Support, which is a legal agreement between the sponsor and the U.S. government.

Why Does This Matter?
Immigrant visa applicants who are sponsored by a U.S. citizen or lawful permanent resident may be required to submit an Affidavit of Support. The notice describes the Affidavit of Support as a way to demonstrate adequate financial support. However, certain applicants may qualify for an exemption, and the proposed DS-864E collection would record the reason for an exemption request and supporting documentation.
How Can the Public Participate?
The Department is seeking public comments on the proposed information collection. Individuals and organizations can submit feedback through the Federal Register website, by email, or by mail. Comments must be submitted by November 17, 2026, to be considered in the final decision.
